The following information on data protection is intended to give you an overview of the processing of your personal data by FinanceFarm AG (hereinafter referred to as FinanceFarm). At the same time, you will be informed about your rights under data protection legislation. ​

 

Additional provisions apply to some data processing programs (e.g. terms of use or cookie policy). These are available on the FinanceFarm website. All references to persons in this document refer to persons of both genders.

1. Addressees of this data protection declaration

The information on data protection relates to personal data from:

- Interested parties and users of the website who are natural persons.

- All other natural persons in contact with FinanceFarm and users of the financefarm.com website.

3. Purpose of processing personal data and legal basis for processing

FinanceFarm processes personal data in accordance with applicable data protection regulations. The following purposes are pursued:

3.1. Fulfillment of contractual obligations

Personal data is processed to provide financial and IT services as part of the fulfillment of contracts with our users or to carry out pre-contractual measures based on inquiries. Further information and details about the purpose of processing your personal data can also be found in the respective contractual documents.

3.2. Processing based on consent given

If you have consented to the processing of your personal data for a specific purpose (e.g. evaluation of certain data for marketing purposes), this consent constitutes the lawful basis for the processing of the data. Any consent given to us can be revoked at any time. Please note that such a revocation can only take effect for the future. Processing that took place before consent was revoked is not affected by this.

3.3. Protection of legitimate interests

  • Processing of personal data that goes beyond the fulfillment of a specific contract only takes place if the processing serves to protect legitimate interests of us or third parties. This can be the case, for example, in the following cases:

  • Advertising measures or market and opinion research, provided the use of the data has not been objected to.

  • Measures to further develop services, products and business operations.

  • Measures to assert and enforce legal claims and measures to defend in legal disputes.

  • Measures to ensure our IT security and IT operations.

  • Measures to prevent and investigate crimes and measures to preserve evidence (e.g. in cases of fraud).

3.4. Fulfillment of legal obligations or in the public interest

The processing of personal data may also be necessary on the basis of legal obligations or in the public interest. The purpose of the processing can therefore also relate to the protection of such interests and have a corresponding legal basis.

4. Origin and use of personal data

FinanceFarm processes personal data that is collected as part of the business relationship with the user. Processed personal data can in particular be personal details (name, address and other contact details, date and place of birth as well as nationality), identification data (e.g. passport, ID data) and other authentication data. In addition, the data processed may also include order data (e.g. payment order), data required to fulfill our contractual obligations (e.g. payment transaction data), information about your financial situation, advertising and sales data, documentation data and other data comparable to the aforementioned categories.

5. Access to Personal Information

At FinanceFarm, those people who need it to fulfill our contractual and legal obligations have access to personal data. ​ Service providers and vicarious agents commissioned by us can also have access to personal data for these purposes, provided confidentiality obligations and data protection regulations are adhered to. Service providers and vicarious agents in this sense are companies that provide services in the areas of banking, IT, logistics, printing, telecommunications, debt collection, advice and consulting as well as sales and marketing.

 

When passing on personal data to recipients outside FinanceFarm, compliance with confidentiality obligations and data protection legislation is ensured at all times. Against this background, personal data will only be passed on if this is required by law, the person concerned has consented (e.g. to carry out a specific transaction) or FinanceFarm has been authorized to pass on the relevant information. Under these conditions, possible recipients of personal data include public bodies and institutions that have a legal or official obligation (e.g. law enforcement authorities).

6. Transfer of data abroad or to an international organization

Personal data will be transmitted to locations outside Switzerland to the following extent:

  • As far as this is necessary for the execution of orders (e.g. user queries).

  • To the extent required by law.

  • As long as you have given us your consent.

7. Storage of personal data

Personal data will be processed and stored as long as and to the extent necessary to fulfill our contractual and legal obligations. ​

 

Personal data that is no longer required to fulfill our contractual or legal obligations is regularly deleted, unless the - limited - further processing of personal data is necessary for a contractual or legal purpose. ​

 

In connection with this information on the storage of personal data, it should be noted that our business relationships are usually structured as a continuing obligation and have a long term.

8. Data Security

FinanceFarm has taken appropriate technical and organizational measures to protect your personal data from loss, misuse, unauthorized access, disclosure and alteration. Our security measures include, for example, firewalls, data encryption, physical and technical access restrictions and regular backups.

9. Individual Data Protection Rights

Every data subject has the right to information, the right to rectification, the right to deletion, the right to restrict processing, the right to object to processing and - where applicable - the right to data portability. You also have the right to complain to a data protection supervisory authority. ​

 

You can revoke your consent to the processing of your personal data at any time. Please note that such a revocation can only take effect for the future.

10. Obligation to provide data by the individual

As part of our business relationship, you must provide us with the personal data that is necessary for the establishment and implementation of a business relationship and the fulfillment of the associated contractual obligations, or the data that we are legally obliged to collect. Without this data, we will generally not be able to enter into a contract with you or to fulfill such a contract. ​

 

In particular, we are obliged to identify you using your identity card before entering into a business relationship and to collect and store your name, place and date of birth, nationality, address and identification details. In order for us to be able to fulfill this obligation, you must provide us with the necessary information and documents and inform us immediately of any changes during the course of the business relationship.

11. Information about the use of cookies

FinanceFarm's website uses cookies or advertiser IDs. Cookies are text files that are stored and stored on a computer system via an Internet browser. ​

 

The data subject can prevent the setting of cookies through our website or app at any time by means of an appropriate setting on the Internet browser used and thus permanently object to the setting of cookies. In addition, cookies that have already been set can be deleted at any time using an Internet browser or other software programs. ​
